By registering for a My Stores account (as defined in Section 1) or using any Services on My Stores (as defined below), you agree to be bound by the following terms and conditions of service.
The services offered by My Stores pursuant to the Terms and Conditions of Service include various products and services to help you sell goods and services to buyers online (“Online Services”) by enabling you to create your own online store.
Any such services offered by My Stores are referred to in these Terms of Service as the “Services”. Any new features or tools added to the current Services are also subject to the Terms and Conditions of Service. You can review the current version of the Terms of Service at any time at https://my-stores.gr/en/terms-and-conditions-of-service/.
My Stores reserves the right to update and change the Terms and Conditions of Service by posting updates and changes on the My Stores website. We advise you to check the Terms and Conditions of Service from time to time for any updates or changes that may affect you and if you do not accept such modifications, you must stop using our Services.
You must read, agree to and accept all Terms and Conditions of Service contained in or expressly referenced in these Terms and Conditions of Service, including the My Store Acceptable Use Policy and Privacy Policy and, if applicable, the Supplemental Terms of Service for EU Merchants (“EU Terms”) before registering for an account or using any My Stores Service. Additionally, if you are offering goods or services related to COVID-19, you must read, acknowledge, and agree to the COVID-19 Related Products Sale Rules of Engagement.
You are responsible for your Account and any Content you upload to the My Stores Service. Please note that if you violate these terms, we may terminate your service. If we need to contact you, we will send you an email.
A. Account Terms
- To access and use the Services, you must register by providing your full name, current address, telephone number, a valid email address and any other information indicated as required. My Store may reject your application for an Account or cancel an existing Account, in the event of non-compliance, in its sole discretion.
- You must be over 18 years of age to use the Services and open an Account.
- You confirm that you are receiving any Services provided by My Store for business purposes and not for any personal, household or family purposes.
- You acknowledge that My Stores will use the email address you provide when opening an Account or as notified by you from time to time as the primary method of communication with you. You must monitor the primary account email address you provide to My Stores, and your primary account email address must be able to send and receive messages. Your email communications with My Stores can only be verified if they originate from your primary account email address.
- You are responsible for the security of your password. My Store cannot and will not be liable for any loss or damage resulting from your failure to maintain the security of your Account and password.
- You acknowledge that you are responsible for the creation and operation of your My Stores.
- You acknowledge and agree to provide public contact information, a refund policy, and order fulfillment schedules on your My Stores.
- My Stores is not a marketplace. Any contract for sale through My Store is directly between you and the buyer.
- You are responsible for all activity and content, such as photographs, images, videos, graphics, written content, audio files, code, information or data that is uploaded, collected, created, stored, displayed, distributed, transmitted or exposed in connection with your account (“Materials”).
- A violation of any term of the Terms and Conditions of Service as determined in My Store’s sole discretion may result in immediate termination of your Services.
Only one person can be a “Store Owner”, usually the person who signs up for the My Stores Services. The Store Owner is responsible for the Account, is bound by these Terms and Conditions of Service, and is responsible for the actions of others who access the Account. We automatically create certain accounts for you to accept payments. You are responsible for activating and deactivating these accounts and complying with their terms, which are with various third parties. Any domain you purchase through us will automatically renew unless you opt out.
B. Account Activation – Store Owner
- The person who registers for the Service by opening an Account will be the contracting party (“Store Owner”) for the purposes of our Terms and Conditions of Service and will be the person authorized to use any corresponding Account that we may provide to the Store Owner in connection with the Service you have selected. You are responsible for ensuring that the Store Owner’s name (including the legal name of the company owning the Store, if applicable) is clearly visible on the Store website.
- Your My Stores store may only be associated with one Store Owner. A Store Owner may have multiple My Stores stores. “Store” means the online store or physical retail locations associated with the Account.
- PayPal Express Checkout Accounts
1. You acknowledge that PayPal Express Checkout and Bank Payments will be your default payment gateways and that it is your sole responsibility as a Store Owner to activate and maintain these accounts. If you do not wish to keep any of your payment accounts active, it is your responsibility to deactivate them. For the avoidance of doubt, PayPal Express Checkout is a Third Party Service.
- Domain Names
1. When purchasing a domain name through My Stores, the domain registration will be set to automatically renew (annual for com names, every 2 years for gr ) as long as your My Stores account remains active.
The My Stores service is a member of I FEEL MEDIA GROUP MON. IKE and the registered office of I FEEL MEDIA GROUP, which is based in the Municipality of Heraklion, Attica, at 115 Prasinou Lofou Street and is legally represented (hereinafter for the sake of brevity, the company) and which and the rights and obligations relating to it are governed by the terms and conditions of service set out herein and in its integral parts and apply to all of its content and its individual pages. You are not allowed to remove it or use it for any illegal or frivolous purpose.
C. General Terms
You must read, agree to and accept all of the terms and conditions of service contained in these Terms and Conditions of Service before becoming a User of My Stores. In addition, you acknowledge and agree to the Rules of Engagement for the Sale of COVID-19 Related Products, if you sell such products.
- Technical support in connection with the Services is provided only to My Stores Users.
- The Terms of Service shall be governed by and construed in accordance with the laws of Greece in force therein, without regard to principles of conflict of laws. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms of Service and is expressly excluded.
- You acknowledge and agree that My Stores may modify these Terms of Service at any time by posting the relevant amended and restated Terms of Service on the My Stores website, available at https://my-stores.gr/en/terms-and-conditions-of-service/ and such amendments to the Terms of Service shall be effective from the date of posting. Your continued use of the Services following the posting of the amended Terms of Service on the My Stores website constitutes your agreement and acceptance of the amended Terms and Conditions of Service. If you do not agree to any changes to the Terms of Service, do not continue to use the Service
- You may not use the My Stores Services for any unlawful or unauthorized purpose nor may you, in using the Service, violate any laws in your jurisdiction (including, without limitation, copyright laws), the laws applicable to you in your customer’s jurisdiction. You will comply with all applicable laws, rules and regulations in your use of the Service and in fulfilling your obligations under the Terms of Service.
- You agree not to reproduce, copy, sell, resell or exploit any portion of the Service, use of the Services or access to the Services without the express written permission of My Stores.
- You will not copy keywords (such as Google Ads) or domain names that use trademarks such as My Stores and/or variations and misspellings thereof from search engines.
- Questions regarding the Terms of Service should be directed to My Stores Support.
The Terms of Service are available in Greek and English
- All terms and provisions of the Terms of Service shall be binding on and inure to the benefit of the parties to the Terms of Service and their respective heirs, successors, authorized assigns and legal representatives. My Stores shall be permitted to assign these Terms of Service without notice to you or your consent. You shall have no right to assign or otherwise transfer the Terms of Service, or any of your rights or obligations hereunder, to any third party without the prior written consent of My Stores, which shall be given or withheld at the sole discretion of My Stores.
- If any provision or part of a provision in these Terms and Conditions of Service is held, for any reason, to be invalid, illegal or unenforceable in any respect, then such invalidity, illegality or unenforceability shall not affect any other provision (or the unaffected part of the provision) of the Terms and Conditions of Service and the Terms and Conditions of Service shall be construed as if such invalid, illegal or unenforceable provision or part of the provision had never been included in the Terms and Conditions of Service.
If a dispute arises, you may bring an action. The Greek courts shall have jurisdiction.
D. My Stores Contracting Party
- You irrevocably and unconditionally agree to submit to the jurisdiction of the Greek courts, which shall have jurisdiction to resolve any disputes that may arise out of or in connection with the validity, effect, interpretation or performance of these Terms of Service and you likewise irrevocably and unconditionally waive any objection to any claim that any action or proceeding has been brought by My Stores in any other jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms of Service and is expressly excluded.
We may modify, cancel or refuse service at any time.
In the event of an ownership dispute regarding a My Stores account, we may freeze the account or transfer it to the rightful owner, as determined by us.
E. My Stores Rights
We reserve the right to modify or terminate the Services for any reason, without notice at any time. Not all Services and features are available in all jurisdictions and we are not obligated to make any Services or features available in any jurisdiction.
We reserve the right to refuse service to anyone for any reason at any time.
We may, but have no obligation to, remove Materials and suspend or terminate Accounts if we determine in our sole discretion that goods or services offered through a Store or Materials uploaded or posted to a Store violate our Acceptable Use Policy or these Terms and Conditions of Service.
Verbal or written abuse of any kind (including threats of abuse or punishment) of any My Stores customer, employee, or member of My Stores will result in immediate termination of the Account.
My Stores does not endorse Materials and it is in our sole discretion to refuse or remove any Materials from the Service, including your Store.
We reserve the right to provide our services to your competitors and do not promise exclusivity in any particular market segment. Further, you acknowledge and agree that My Stores employees and contractors may also be My Stores customers/merchants and may compete with you, although they may not use your Confidential Information to do so.
In the event of a dispute regarding account ownership, we reserve the right to request documentation to determine or verify account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government photo ID.
My Stores reserves the right to determine, in our sole discretion, the legal ownership of an Account and to transfer an Account to the rightful Store Owner. If we are unable to reasonably determine the rightful Store Owner, without prejudice to our other rights and remedies, My Stores reserves the right to temporarily disable an Account until a resolution is determined between the disputing parties.
Both you and My Stores agree to use the other’s Confidential Information only to perform the obligations under these Terms and Conditions of Service. Confidential information must be protected and respected.
G. Confidentiality
- “Confidential Information” includes, but is not limited to, all information related to a party’s business that is not publicly known, including specific business information, technical processes and formulas, software, customer lists, lists of potential customers, names, addresses and other information about customers and prospective customers, product designs, sales, costs (including any related processing fees), price lists and other unpublished financial information, business plans and marketing data and any other confidential and proprietary information, even if marked as confidential or proprietary. My Stores Confidential Information includes all information you receive about us or the Services.
- As required by any law, regulation or order of any court of competent jurisdiction over the parties and the subject matter contained in these Terms and Conditions of Service, provided that, if legally permissible, the recipient will give the disclosing party written notice and use commercially reasonable efforts to ensure that such disclosure is treated confidentially. Confidential Information does not include any information that the recipient can demonstrate: (A) was already in the public domain or was already known or in the possession of the recipient at the time of disclosure of such information. (B) is independently developed by the recipient without use of or reference to the Confidential Information of the other party and without breach of any provisions of these Terms of Service.
We are not responsible if you violate the law, violate this agreement, or violate the rights of third parties, especially if you are sued.
The service is “as is”, so it may have errors or interruptions and we provide no warranty and our liability is limited.
H. Limitation of Liability
You expressly understand and agree that, to the extent permitted by applicable law, My Stores shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses arising out of the use of or inability to use the Service.
- To the extent permitted by applicable law, in no event shall My Stores or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our website, our Services or these Terms of Service (whether or not arising from negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, My Stores affiliates, officers, directors, agents, employees and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents it incorporates by reference, or your violation of any law or the rights of a third-party.
- Your use of the Services is at your sole risk. The Services are provided “as is” and “as available” without any warranties or conditions, express, implied or statutory.
If My Stores chooses not to enforce any of these provisions at any time, it will not be a waiver of that right later. These Terms of Service constitute the entire agreement between you and us. This means that any prior agreements between you and My Stores are invalid if they conflict with these terms.
I. Waiver, Severability and Entire Agreement
- The failure of My Stores to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service, including all terms and conditions of Service and other documents incorporated by reference, is held by a court of competent jurisdiction to be contrary to law, that provision shall be modified and construed so as to best achieve the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the Terms of Service shall remain in full force and effect.
- The Terms of Service, including the documents it incorporates by reference, constitute the entire agreement between you and My Stores and govern your use of the Services and your Account, superseding any prior agreements between you and My Stores (including, without limitation, any prior versions of the Terms of Service).
Anything you upload remains yours and is your responsibility.
I. Intellectual Property and Customer Content
- We do not claim any intellectual property rights in the Materials you provide to the My Stores Service. All Materials you upload to the My Stores store remain yours. You may remove the My Stores store at any time by deleting your account.
- By uploading Materials, you agree: (a) to allow other Internet users to view the Materials you post publicly on your Store. (b) to allow My Stores store to store and, in the case of Materials you post publicly, to display and use your Materials. and (c) that My Stores store may, at any time, review and delete any Materials submitted to its Service, although My Stores store is not obligated to do so.
- You retain ownership of all Materials that you upload to the Store. However, by making your Store public, you agree to allow others to view Materials that you post publicly on your Store. You are responsible for compliance of the Materials with any applicable laws or regulations.
- My Stores store will have the non-exclusive right and license to use the names, trademarks, service marks, and logos associated with your Store to promote the Service.
By using the Email Services, you agree that My Stores may use certain tools to ensure that the content of emails sent through the service is secure and complies with our policies.
M. Email
- My Stores uses certain controls to scan the content of emails you deliver using the Email Services prior to delivery (“Content Scanning”). This Content Scanning is intended to limit spam, phishing, or other malicious content that violates these Terms of Service or the My Stores Acceptable Use Policy (collectively, “Threats”). By using the Email Services, you expressly grant My Stores the right to use this Content Scanning. My Stores does not warrant that the Email Services will be free of threats, and each My Stores merchant is responsible for all content generated by its respective Stores.
- By creating or sending emails through the Email Services, you agree to comply with the following requirements (the “Email Service Requirements”). My Stores or its third party providers may suspend or terminate your access to and use of the email services if you fail to comply with the email service requirements.
- Your use of the Email Services must comply with all applicable laws. Examples of applicable laws include laws relating to spam or unsolicited commercial email, privacy, security, obscenity, defamation, copyright, pornography, terrorism, homeland security, gambling, child protection, and other applicable laws. It is your responsibility to know and understand the laws that apply to your use of the Email Services and the emails you create or send through the Email Services.
- Your use of the Email Services must comply with My Stores’ Privacy Policy. It is your responsibility to read and understand the Privacy Policy that applies to your use of the Email Services and the emails you create or send through the Email Services.
- You will use commercially reasonable efforts not to send sensitive personal data, including information about an individual’s medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs, or other sensitive data (collectively, “Sensitive Data”) through the Email Services. It is your responsibility to read and understand your obligations with respect to Sensitive Data.
- Your use of the Email Services must follow all applicable guidelines established by My Stores. The following guidelines are examples of practices that may violate the Email Services Requirements when creating or sending email messages through the Email Services:
- using non-permission-based email lists (i.e., lists in which each recipient has not expressly granted permission to receive email messages from you by affirmatively opting in to receive such email messages)
- using third-party email addresses, domain names, or mail servers without the appropriate permission
- sending email messages that result in an unacceptable number of spam or UCE complaints (even if the email messages themselves are not actually spam or UCE)
- failing to include a functional “unsubscribe” link in each email that allows the recipient to remove themselves from your mailing list
- failing to comply with any request by a recipient to be removed from your mailing list within 10 days from receipt of the request
- failure to include in each email a link to the then-current privacy policy applicable to that email
- disguise the origin or subject of any email or falsify or manipulate the original email address, subject line, headers, or transmission path information for any email
- failure to include in each email your valid physical mailing address or a link to such information, or
- including “junk mail,” “chain letters,” “pyramid schemes,” incentives (e.g., coupons, discounts, prizes, or other incentives) or other material in any email message that encourages a recipient to forward the email to another recipient.
- If you or a customer are aware of or suspect any violations of the Email Service Requirements, please notify My Stores. My Stores will determine compliance with the Email Service Requirements at its sole discretion.
A valid payment method (such as a credit card) is required for all stores. You will be charged for your Subscription Fees every 3 Months. Any transaction fees or additional charges will be charged to your payment method. If you are unable to complete the Fees payment using your payment method, we will try again in 3 days. If you are unable to complete the Fees payment on the second attempt, we will make a third and final attempt three days later. If the Fees payment is not successful after three attempts, My Stores may freeze your store.
L. Payment of Fees
You will pay the fees applicable to your subscription to the online service (“Subscription Fees”) and any other applicable fees, and any fees associated with the purchase or use of any products or services, such as applications, themes, domain names, or third-party services (“Additional Fees”). Together, the subscription fees, transaction fees, and additional fees are referred to as “Fees.”
You must maintain a valid payment method on file with us to pay for all arising and recurring charges. My Stores will charge the applicable fees to any valid payment method you authorize (“Authorized Payment Method”), and My Stores will continue to charge the Authorized Payment Method for the applicable fees until the Services are terminated and all outstanding charges have been paid. Unless otherwise specified, all fees and other charges are in euros and all payments will be made in euros.
Subscription fees are payable in advance and will be charged at the intervals specified (each such date, a “Billing Date”). Transaction fees and additional charges will be charged from time to time at the discretion of My Stores. You will be charged on each Billing Date for all outstanding fees that have not been previously charged. Charges will appear on an invoice, which will be sent to the Store Owner via the email address provided. Users have approximately two weeks to report and resolve any issues with the charging of Subscription Fees.
If you are unable to complete the payment of Fees using an Authorized Payment Method, we will make a second attempt to process the payment using any Authorized Payment Method 3 days later. If the second attempt is unsuccessful, we will make a final attempt 3 days after the second attempt. If our final attempt is unsuccessful, we may suspend and revoke access to your Account and the Services. Your Account will be reactivated upon payment of any outstanding fees, plus the fees applicable to your next billing cycle. You may not be able to access your Account or your storefront during any suspension period. If outstanding fees remain unpaid for 30 days after the suspension date, My Stores reserves the right to terminate your Account.
All fees are exclusive of applicable federal, provincial, state, local or other governmental sales, goods and services harmonized or other taxes, fees or charges now in effect or in effect in the future (“Taxes”).
You are responsible for all applicable taxes arising from or as a result of your subscription to or purchase of My Stores products and services. To the extent My Stores charges such taxes, they are calculated using the tax rates applicable to the billing address you provide to us. These amounts are in addition to the Charges for such products and services and will be charged to your Authorized Payment Method. If you are exempt from paying such Taxes, you must provide us with evidence of your exemption, which in some jurisdictions includes an original certificate that meets applicable legal requirements certifying your tax-exempt status. The tax exemption will only be effective from and after the date we receive satisfactory evidence to My Stores of your exemption. For the avoidance of doubt, all amounts paid by you to My Stores under these Terms of Service will be paid free of any deductions or withholdings.
You are responsible for all applicable taxes arising from or as a result of any sale at your My Stores store.
You must maintain an accurate location in your My Stores store management menu. If you change jurisdictions, you must promptly update your location in your management menu.
M. Refund
From the moment you accept the My Stores services including the terms and conditions of service and after purchasing a subscription, you will receive the invoice within 24 hours to the email address you have provided. In case the amount has been paid via online purchase and you wish to terminate the cooperation with My Stores and not create a store, then you will receive 50% of the initial payment. In case the invoice has been issued, then the money is not refunded and the entire amount paid is retained.
To initiate a termination, contact Support. My Stores will respond with specific information regarding the termination process of your account. Once the termination is confirmed, the domains purchased through My Stores will no longer be automatically renewed. If you cancel in the middle of your billing cycle, you will receive a final invoice via email.
We may change or terminate your account at any time. Any fraud will result in your account being suspended or terminated.
N. Cancellation and Termination
You may cancel your Account and terminate the Terms of Service at any time by contacting My Stores Support and then following the specific instructions provided to you in My Stores’ response.
- In the event of termination of the Services by either party for any reason:. My Stores will cease to provide you with the Services and you will no longer be able to access your Account
. except as otherwise provided in the Terms of Service, you will not be entitled to refunds of any Fees, prorated or otherwise
. any outstanding balance owed by you to My Stores for your use of the Services up to the effective date of such termination will immediately become due and payable in full
. Your store website will be disconnected.
- If you purchased a domain name through My Stores, upon cancellation your domain will no longer automatically renew. After termination, it will be your sole responsibility to handle all matters related to your domain with your domain provider.
- If, on the date of termination of the Service, any outstanding charges are due from you, you will receive a final invoice via email. Once the invoice is paid in full, you will not be charged again.
- We reserve the right to modify or terminate the My Stores Service, the Terms of Service and/or your Account for any reason, without notice at any time (except as otherwise required by applicable law). Termination of the Terms of Service will not affect any rights or obligations that arose prior to the date of termination.
- Fraud: Without limiting any other remedies, My Stores may suspend or terminate your Account if we suspect that (by conviction, settlement, insurance or escrow investigation or otherwise) you have engaged in fraudulent activity in connection with your use of the Services.
We may change or discontinue the service at any time, without liability.
O. Purchasing Third Party Services and Experts
- Third Party Services are provided as a convenience only, and your purchase, access, or use of any such Third Party Services is solely between you and the applicable third party service provider (“Third Party Provider”). In addition to these Terms of Service, you also agree to be bound by the additional terms of service that apply to services you purchase from or provided by Third Party Providers.
- My Stores is an online directory of independent third parties (“Experts”) who can help you create and operate your My Stores.
- You may engage and work with an Expert directly.
- Any use by you of Third Party Services offered through the My Stores Services is at your sole risk and discretion, and it is your responsibility to read the terms and conditions and/or privacy policies applicable to such third parties before using them.
- We make no warranties or representations to you regarding Third Party Services. You acknowledge that My Stores has no control over Third Party Services and shall not be liable to you or anyone else for such Third Party Services. The availability of Third Party Services on the My Stores websites. The integration or activation of such Third Party Services with the Services does not constitute or imply endorsement, authorization, sponsorship or relationship by or with My Stores. My Stores does not guarantee the availability of Third Party Services and you acknowledge that it may disable access to any Third Party Services at any time in its sole discretion and without notice to you. My Stores is not responsible or liable to anyone for the interruption or suspension of access to or deactivation of any Third Party Service. My Stores strongly recommends that you seek professional advice before using or relying on Third Party Services to ensure that they will meet your needs.
- If you install or enable a Third Party Service for use with the Services, you grant us permission to allow the relevant Third Party Provider to access your data and other Materials and to take any other actions necessary for the interoperability of the Third Party Service with the Services, and any exchange of data or other Materials or other interaction between you and the Third Party Provider is solely between you and such Third Party Provider. My Stores is not responsible for any disclosure, modification or deletion of your data or other Materials or for any corresponding loss or damage that you may suffer as a result of a third-party service or third-party provider accessing your data or other Materials. Google Maps is a third-party service used in the Services. Acceptable Use Policy , Google Maps and Google Earth Additional Terms of Service and the Google Privacy Policy as may be amended by Google from time to time.
- You acknowledge and agree that: by submitting a request for assistance or other information through Support, you consent to one or more Experts contacting you at the Store Owner’s registered email address (or other email address provided by you) as well as the applicable user email address; and My Stores will receive all email communications exchanged through Support or in any response emails.
- The relationship between you and any Third Party Provider is strictly between you and such Third Party Provider and My Stores is not obligated to intervene in any dispute arising between you and a Third Party Provider.
- In no event will My Stores be liable for any direct, indirect, incidental, special, consequential, punitive, extraordinary, exemplary or other damages arising out of any Third Party Services or your contractual relationship with any Third Party Provider, including any Expert. These limitations apply even if My Stores has been advised of the possibility of such damages. The above limitations apply to the maximum extent permitted by applicable law.
- You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, My Stores affiliates, officers, directors, agents, employees and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of a third-party service or your relationship with a third-party provider.
P. Feedback and Reviews
My Stores respects intellectual property rights, just as you do. If we receive a DMCA Notice, we may disable access to or remove the allegedly infringing content from your site. If you do not believe the claim is valid, you may proceed with a counter-notification.
If you believe that one of our merchants is infringing on your intellectual property rights, you may send My Stores a DMCA Notice. We will promptly disable access to or remove the content and notify the merchant.
R. DMCA Notice and Takedown Procedure
My Stores supports the protection of intellectual property and requires Eyefindyou merchants to do the same. It is our policy to respond to all notices of alleged copyright infringement. If anyone believes that one of our merchants is infringing on their intellectual property rights, they may submit a DMCA Notice to My Stores’ designated agent using our form. Upon receipt of a DMCA Notice, we may remove or disable access to Materials that are claimed to be infringing. Once a takedown notice has been served, the merchant may respond with a counter-notice using our form if they dispute the complaint. The original complainant has 14 business days after we receive a counter-notification to seek a court order prohibiting the merchant from engaging in the infringing activity, or we will reinstate the material. Only My Stores users and individuals who access the My Stores Services have rights under these Terms of Service.
S. Third Party Rights
Storage for My Stores and its affiliates, My Stores Users or anyone accessing the My Stores Services pursuant to these Terms of Service, except as otherwise provided in these Terms of Service, no person or entity that is not a party to these Terms of Service shall have the right to enforce any term of these Terms of Service, regardless of whether such person or entity is identified by name, as a member of a class, or as meeting a particular description. For the avoidance of doubt, this does not affect the rights of any permitted assignee of these Terms.
My Stores’ use and collection of personal information is governed by our Privacy Policy. Additionally, if you or your customers are located in Europe, My Stores’ use and collection of European personal information is further governed by our Data Processing Addendum.
T. Privacy & Data Protection
My Stores is committed to protecting the privacy of your personal information and the personal information of your customers. By using the Service, you acknowledge and agree that My Stores’ collection, use and disclosure of such personal information is governed by our Privacy Policy.
Additionally, if you: (a) are located in the European Economic Area (EEA); (b) provide goods or services to customers in the EEA; or (c) are otherwise subject to the requirements of the EU General Data Protection Regulation, My Stores’ collection and use of personal information of any European resident is also subject to our Data Processing Addendum. |
